Constitution - July 2003


ARTICLE I: NAME
The name of the Association shall be the Dallas Claims Association;

ARTICLE II: PURPOSE
Section 1: To promote harmony and cordial business relations among members, to exchange information concerning matters of interest, to discuss common problems, to develop a high standard of ethics and to promote the general welfare of the insurance industry and the members of the association.

Section 2: To insure through cooperation of its members such administration of property and casualty claims as will result in a prompt and just settlement of meritorious claims.

Section 3: To promote plans for cooperation in vigorously resisting collusion, deception and false or fraudulent claims and losses and promptly to discourage and expose dishonest, unscrupulous and unethical practices, whether indulged in by professional men / women.

Section 4: To agree that everything discussed at meetings of the organization or committees shall be held in strict confidence unless otherwise agreed. Further that the knowledge gained through membership in the Association shall not be used against the interest of any individual member or any company having a full accredited representative in the Association.

ARTICLE III - Membership
Section 1: Membership shall consist of active members and associate members.

Active Company Membership: Shall be insurance companies, self-insured or independent insurance adjusting firms employing Texas licensed adjusters who are directly engaged in handling of insurance claims and losses.

Active Individual Membership: Shall be Texas licensed adjusters directly engaged in handling of insurance claims and losses. Individuals are not eligible for Individual Membership if your company is registered as a company member.

Associate Membership: Shall be limited to companies who are engaged in related lines to the insurance industry, such as support services. Associate members are not eligible for individual membership or company membership, even if they hold a Texas adjusters license.

Section 2: The organization shall be non-union in every respect.

ARTICLE IV: OFFICERS
Section 1: The officers shall be a President, First Vice President, Second Vice President, Secretary, Treasure. These officers shall be elected at the June meeting or as soon thereafter as possible for a term of one year and shall assume the duties of their office at the beginning of the fiscal year, September 1.

ARTICLE V: EXECUTIVE BOARD
Section 1: The Governing body of the Association shall be the Executive Board consisting of the Officers and the two immediate Past Presidents.

ARTICLE VI: MEETINGS
Section 1: The meetings shall be held at least once a month on the first Wednesday of the month unless otherwise designated from September through August.

Section 2: The fiscal year shall be September 1 through August 31 of the following year.


ARTICLE VII: AMENDMENTS

The Constitution may be amended by a two-thirds vote of the membership in attendance at any regular meeting or special meeting of the Association. Notice of the regular meeting or special meeting must be given in writing two weeks prior to the meeting. Any amendment of the Constitution shall become effective immediately upon its adoption.
